1. Exclusive Jurisdiction & Governing Law
These terms, our platform architecture, and any resulting legal disputes are governed exclusively and absolutely by the laws of Bharat (India), expressly rejecting any conflict of law principles.
Any permitted legal action or proceeding shall be brought exclusively in the state or federal courts located in New Delhi, and you irrevocably consent to the personal jurisdiction of such courts.
2. Mandatory Binding Arbitration Protocol
Any controversy, dispute, or claim arising out of your relationship with ATMAN shall be settled by mandatory, final, and binding arbitration. This is an absolute, non-negotiable condition of utilizing our platform.
You expressly, knowingly, and irrevocably waive your constitutional right to a trial by judge or jury, or to participate in any conventional court proceeding against ATMAN.
3. Absolute Class Action & Representative Waiver
You agree that any arbitration or proceeding will be conducted solely and exclusively on an individual basis.
You explicitly and irrevocably waive any right to bring, participate in, consolidate, or benefit from any class action, mass action, or representative proceeding of any kind against ATMAN.
4. Strict Time Limitation on Claims
Any claim or cause of action arising out of or related to the use of the ATMAN platform or our Terms of Service must be filed within precisely one (1) year after such claim arose.
If not filed within this one-year period, the claim or cause of action is permanently, legally, and forever barred.
5. Equitable Relief & Injunctions
Notwithstanding the arbitration agreement, ATMAN retains the absolute right to seek immediate injunctive or equitable relief in any court of competent jurisdiction to prevent the infringement, misappropriation, or violation of our intellectual property.
6. Allocation of Legal Fees and Costs
In the event that ATMAN prevails in any arbitration or legal proceeding against you, you shall be held strictly liable for all of our reasonable attorneys' fees, court costs, and administrative expenses associated with the dispute.
7. Notice of Dispute & Pre-Arbitration
Before commencing arbitration, you must send a formal, written Notice of Dispute to legal@atmanluxury.in, detailing the specific grievance and requested relief.
You agree to engage in good-faith informal resolution for a mandatory period of ninety (90) days before any formal arbitration can be initiated.
